TEXT ON THE PROCESSING OF PERSONAL DATA

Data Controller and Representative

Pursuant to Law No. 6698 on the Protection of Personal Data (“Law No. 6698”), your personal data may be processed by IVOSIS Steel Industry Trade Ltd. (“Company”) as the data controller within the scope described below.

 

 

Purpose of Processing Personal Data

Your personal data collected, subject to the processing of your personal data; establishment and continuation of the employment contract, delivery of the materials and equipment required for the performance of the work, planning and execution of our Company’s human resources policies, fulfillment of the obligations arising from the legislation to which our Company is subject, especially the Labor Law and Occupational Health and Safety legislation, creation and storage of your personnel file, promotion, seniority, salary and advance payments, salary increase and establishment of fringe benefits procedures, implementation of performance evaluation processes, Planning business travels and carrying out the necessary transactions within this scope, monitoring and auditing the devices and contact addresses allocated to you within the scope of the employment contract, obtaining legal support in possible disputes and legal processes and using it as a means of proof, following up expense and permission forms, fulfilling obligations regarding social insurance, and also for the purposes of ensuring the legal and commercial security of our Company and the persons who have a business relationship with our Company, and developing and improving the recruitment principles applied by our Company within the scope of the personal data processing conditions specified in Articles 5 and 6 of Law No. 6698. and 6. of the Law No. 6698 for the purposes of fulfillment of obligations regarding social insurance and also for the purposes of ensuring the legal and commercial security of our Company and persons who have a business relationship with our Company and developing and improving the recruitment principles applied by our Company. 

  

To whom and for what purpose the processed personal data can be transferred

Your collected personal data may be shared with the relevant bank in order to realize your salary payments and fringe benefits within the scope of the performance of the employment contract. In addition, your personal data may be shared with the relevant consulates and the visa consultancy firm from which our Company receives services within the scope of planning business trips; with the Ministry of Labor and Social Security, Social Security Institution, OHS and workplace medicine service provider, Turkish Employment Agency, courts and other public institutions and organizations requesting information when necessary within the scope of fulfilling the legal obligations of our Company; law offices and other consultants, independent audit companies in order to obtain legal support within the scope of the establishment, use and protection of our Company’s rights. Your personal data may be shared within the framework of the above-mentioned data processing purposes and the personal data processing conditions specified in Articles 8 and 9 of Law No. 6698.

 

Method and Legal Grounds for Collecting Personal Data

Your personal data is collected by our Company through different channels and in physical or electronic environment based on the legal reasons explained below; from you personally or through websites that allow you to apply for a job, via e-mail, security cameras, through documents such as job application form, expense and permission form, etc. that you have filled out for the purposes listed above within the scope of the employment contract and other methods.

  1. Based on the legal reason of “explicit consent” regulated in Article 5/1 of Law No. 6698, the Company will be able to process your personal data and sensitive personal data that you transmit to the Company with your explicit consent within the scope of the following explicit consent statement in accordance with the Personal Data Protection Law No. 6698 and secondary regulations.
  2. Based on the legal reason “expressly stipulated in the laws” regulated in paragraph 5/2 (a) of Law No. 6698, your personal data may be processed in cases expressly permitted by the legislation to which our Company is subject, especially the Labor Law and Occupational Health and Safety legislation.
  3. Your personal data based on the legal reason of “establishment or performance of the contract” regulated in Article 5/2 (c) of Law No. 6698; making the necessary determinations and evaluations before the employment contract, fulfilling the requirements of the employment contract and ensuring its continuity, establishing the salary payments and fringe benefits of the employee, auditing whether the employee complies with the obligations arising from the employment contract, conducting performance evaluations, promotion, seniority and salary increase processes and planning business travels and carrying out the necessary transactions within this scope, tracking the devices and contact addresses allocated to you within the scope of the employment contract and ensuring other personal rights.
  4. Based on the legal reason of “fulfillment of the legal obligation of the data controller” regulated in Article 5/2 (ç) of Law No. 6698, the Company may process your personal data for the purposes of creating and storing your personal file, fulfilling the requests of the Ministry of Labor and Social Security, Social Security Institution, Turkish Employment Agency, courts and other public institutions and organizations requesting information and fulfilling other legal obligations.
  5. Based on the legal reason of “establishment, exercise or protection of a right” regulated in subparagraph 5/2 (e) of Law No. 6698, the Company may process your personal data for the purposes of being a means of proof in possible disputes, obtaining legal consultancy and technical support, implementing the employment contract, and auditing whether the parties comply with their obligations.
  6. Based on the legal reason of “legitimate interest of the data controller” regulated in Article 5/2 (f) of Law No. 6698, the Company may process your personal data for the purposes of planning, improving and executing the Company’s human resources policies, developing and implementing our Company’s commercial and business strategies, performing customer audit processes and other legitimate purposes.
 
Your Rights Listed in Article 11 of Law No. 6698

As personal data owners, if you submit your requests regarding your rights to the Company by the methods regulated in the Communiqué on the Procedures and Principles of Application to the Data Controller, our Company will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board will be charged by the Company. In this context, as a personal data owner;  

  1. Learn whether your personal data is being processed,
  2. Request information if your personal data has been processed,
  3. To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
  4. To know the third parties to whom your personal data is transferred domestically or abroad,
  5. To request correction of your personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom your personal data has been transferred,
  6. Although it has been processed in accordance with the provisions of Law No. 6698 and other relevant laws, to request the deletion or destruction of your personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom your personal data has been transferred,
  7. To object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems,
  8. In case of damage due to unlawful processing of personal data, you have the right to demand compensation for the damage.

PROCESSING OF PERSONAL DATA EXPLICIT CONSENT DECLARATION    

Within the scope of the Clarification Text submitted to my knowledge above, my health data to be processed in order to carry out the processes related to recruitment, periodic and polyclinic examination report and occupational health and safety processes and other legal obligations; my criminal record to be processed in the recruitment process within the scope of the implementation of the Company’s human resources policies and procedures and to be kept in your personnel file; In addition, I hereby consent to the sharing of my personal data and sensitive personal data with the Ministry of Labor and Social Security, Social Security Institution, Turkish Employment Agency, relevant labor unions, courts and other public institutions and organizations requesting information, and with law offices and other consultants to obtain legal support within the scope of the establishment, use and protection of the Company’s rights.

Within the scope of the processes stated in this Explicit Consent text, your personal data will be processed based on the legal reason of “explicit consent” regulated in Article 5/1 and Article 6/1 of Law No. 6698. You have the right to withdraw your explicit consent to the processing of your personal data at any time by applying to our Company.
